Terms of Use
Effective date: October 21, 2026
Last updated: October 21, 2026
The website located at eicaschool.com (the "Site") is owned and operated by Ebenezer International Christian Academy ("EICA," "we," "us," or "our"), a private, Cognia-accredited online Christian high school. These Terms of Use (the "Terms") govern your access to and use of the Site, including its pages, contact form, teacher application form, and any other features we offer on the Site. Certain features of the Site may be subject to additional guidelines or rules posted on the Site, which are incorporated into these Terms by reference.
By accessing or using the Site, you agree to these Terms. If you are using the Site on behalf of a student or another person, you confirm that you have the authority to do so. If you do not agree to these Terms, please do not use the Site.
These Terms include a choice of Florida law, a requirement that disputes be brought in the courts located in Miami-Dade County, Florida, and a waiver of the right to a jury trial (see the "Governing Law and Disputes" section below). Please read them carefully.
1. Who May Use the Site
The Site is intended for prospective and current students, parents and guardians, job applicants, and members of the public who want to learn about EICA. Many of our students are under 18. If you are under 18, you may use the Site only with the involvement and permission of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Site. Children under 13 should not submit any personal information through the Site without the consent of a parent or guardian. For more information, see our Privacy Policy.
2. Access to the Site
License. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own personal, non-commercial purposes, such as learning about our programs, contacting us, and applying for enrollment or employment.
Changes to the Site. We may modify, suspend, or discontinue the Site, or any part of it, at any time, with or without notice. We are not liable to you or anyone else for any such modification, suspension, or discontinuation.
Information on the Site. We work to keep the information on the Site, including program descriptions, calendars, course offerings, and pricing, accurate and current. However, this information is provided for general informational purposes and may change. The terms of your enrollment are set by your signed enrollment agreement, as described below.
3. Student Accounts and the Edutino Platform
The Site itself does not offer user accounts. Enrollment, student and parent or guardian accounts, coursework, grades, surveys, and online payments are handled through the Edutino platform (for example, eica.edutino.com and edutino.com/enroll), a third-party student information system that EICA uses. When you use Edutino, you are also subject to Edutino's own terms and policies, which govern your account there. Please review them before creating an account. You are responsible for keeping your Edutino login credentials confidential and for notifying us promptly if you believe your account has been accessed without authorization.
4. Enrollment, Tuition, and Payments
These Terms govern your use of the Site only. Enrollment at EICA, tuition, fees, payment plans, cancellations, refunds, and the issuance of transcripts and diplomas are governed by the enrollment agreement you sign with EICA, together with our Refund Policy and our Secure Payments page. If anything in these Terms conflicts with your signed enrollment agreement on those matters, the enrollment agreement controls.
Online payments are processed by Stripe, our third-party payment processor. EICA does not see or store your full card number. Your use of Stripe is subject to Stripe's own terms and privacy policy.
5. Forms, Applications, and Other Submissions
The Site lets you send us information, for example through our contact form and our teacher application form (which may include your resume). When you submit information, you agree that:
- the information you provide is accurate, complete, and your own (or you have the right to share it);
- you will not submit anything unlawful, misleading, harmful, or that infringes the rights of others; and
- we may use the information to respond to you, review your application, and operate our school, as described in our Privacy Policy.
Submitting an application or inquiry does not guarantee admission, employment, or any particular response. Our forms use hCaptcha to help prevent spam, and your use of hCaptcha is subject to its own terms and privacy policy.
Feedback. If you share feedback or suggestions about the Site or our school, you grant us a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to use that feedback for any purpose, without compensation or attribution. Please do not send us feedback that you consider confidential or proprietary.
6. Intellectual Property
The Site and its content, including text, graphics, logos, photographs, videos, and course descriptions, are owned by EICA or its licensors and are protected by copyright, trademark, and other laws. These Terms do not transfer any ownership rights to you. All rights not expressly granted in these Terms are reserved.
You may view and print pages of the Site for your personal, non-commercial use. You may not copy, reproduce, distribute, republish, modify, create derivative works from, publicly display, sell, or otherwise exploit any part of the Site or its content without our prior written permission, and you must keep all copyright and other notices intact on any copy you are permitted to make. The EICA name, logo, and related marks may not be used without our prior written consent.
7. Prohibited Conduct
When using the Site, you agree not to:
- use the Site in any way that violates any applicable law or regulation;
- impersonate any person, including a student, parent, guardian, or EICA staff member, or misrepresent your affiliation with anyone;
- submit false information, spam, chain letters, or unsolicited advertising through our forms;
- upload or transmit viruses, malware, or any other harmful code;
- attempt to gain unauthorized access to the Site, our systems, or any account, or interfere with or disrupt the Site or its security features (including our spam protection);
- use any robot, scraper, or other automated means to access or collect data from the Site, except for standard search engine indexing;
- reverse engineer, decompile, or disassemble any part of the Site, except where the law expressly allows it;
- harass, threaten, or harm any person, or post content that is obscene, hateful, or inappropriate for a school community serving minors; or
- use the Site to build a similar or competing product or service, or otherwise use it for any commercial purpose without our permission.
8. Privacy and Cookies
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share personal information, and is incorporated into these Terms by reference. The Site uses cookies and similar technologies, as described in our Cookie Policy. If there is a conflict between these Terms and the Privacy Policy about the handling of personal information, the Privacy Policy controls.
9. Third-Party Links and Services
The Site may contain links to, or integrations with, websites and services that we do not own or control, including Edutino, Stripe, hCaptcha, social media platforms, and other third-party resources (collectively, "Third-Party Services"). We are not responsible for, and do not endorse, any Third-Party Services. Your use of any Third-Party Service is at your own risk and is subject to that third party's own terms and privacy practices.
10. Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, EICA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL CODE, OR THAT INFORMATION ON THE SITE IS COMPLETE OR CURRENT. Nothing in this section limits any obligation EICA has to enrolled students under their signed enrollment agreement.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) EICA AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY LOST PROFITS, LOST DATA, OR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE SITE; AND (B) OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). This section applies to your use of the Site only. It does not limit any rights or remedies you may have under your signed enrollment agreement, and it does not apply where such limits are prohibited by law.
12. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless EICA and its officers, employees, and agents from any claims, losses, and reasonable costs and attorneys' fees arising out of (i) your misuse of the Site, (ii) your violation of these Terms, or (iii) your violation of any applicable law or the rights of any third party. We may assume control of the defense of any such claim, and you agree to cooperate with our defense.
13. Suspension and Termination
These Terms remain in effect while you use the Site. We may suspend or end your access to the Site at any time, including if we believe you have violated these Terms. Sections 5 through 15 survive any termination of your access.
14. Governing Law and Disputes
Governing law. These Terms, and any dispute arising out of or relating to these Terms or the Site, are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law principles.
Informal resolution. Before filing a claim, please contact us at greisyscue@eicaschool.com so we can try to resolve the concern informally.
Courts. You and EICA agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state and federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction and venue of those courts. However, either party may bring an individual claim in small claims court if the claim qualifies, and either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.
Jury trial waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND EICA EACH WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY LAWSUIT ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE.
15. General
Electronic communications. By using the Site or sending us a message, you consent to receive communications from us electronically, such as by email or notices posted on the Site, and you agree that these communications satisfy any legal requirement that they be in writing. Our text message practices are described in our Privacy Policy.
Entire agreement. These Terms, together with the Privacy Policy, the Cookie Policy, and any other policies referenced in them, are the entire agreement between you and EICA regarding your use of the Site. Your enrollment at EICA is governed separately by your signed enrollment agreement and the policies it references.
Severability and waiver. If any provision of these Terms is found invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in effect. Our failure to enforce any provision is not a waiver of that provision. The word "including" means "including without limitation."
Assignment. You may not assign these Terms without our prior written consent. We may assign them without restriction.
California notice. Under California Civil Code Section 1789.3, California users are entitled to the following notice: the Site is provided by Ebenezer International Christian Academy, 900 W 49th St Suite 562, Hialeah, FL 33012. California residents may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 N. Market Blvd., Suite N112, Sacramento, CA 95834, or by phone at (800) 952-5210.
16. Accessibility
EICA is committed to making the Site accessible to everyone, including people with disabilities. We aim to conform to the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA. If you have difficulty accessing any part of the Site, or have suggestions for improving accessibility, please contact us at info@eicaschool.com or (305) 792-8242, and we will make reasonable efforts to help and to provide the information you need in another format.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated Terms on this page and change the "Last updated" date above. If we make material changes, we may also provide a more prominent notice on the Site or notify you by email. Your continued use of the Site after the updated Terms are posted means you accept them.
